Contract Signing: As per the terms, after approval of the proposal, a formal maintenance contract is signed between Pestkart Enterprises and the Client/Customer based on the following General Terms and Termite Control Terms and Conditions.
1. Termite Control Warranty: Warranty details are specified in the proposal according to site specifications. Note: This warranty does not cover wood repair or replacement as it is strictly a maintenance contract.
2a. Wood Repair Warranty: Applicable when 20% of the fixed woodwork cost of the treated premises is paid as the contract amount. This warranty covers all woodwork fixed to walls (false ceilings are excluded). Only damaged wood will be replaced and fixed as per the previous condition. Paint and finish may vary slightly from the original.
2b. Maximum Liability: The maximum liability under the wood repair warranty or maintenance contract cannot exceed the contracted amount.
2c. Refund Policy:
i) 100% refund if the job is cancelled by phone before execution.
ii) If a technician reaches the site and the job is cancelled by the client, a charge of ₹999/- applies, with the remaining amount refunded.
iii) After completion of the job, if the client requests cancellation and refund within 14 days, 50% refund of the contracted amount is applicable.
iv) From day 15 up to 3 months after job completion, a 20% refund applies. No refunds are available after 3 months.
3. Treatment Procedure: Treatment involves drilling at various points in the premises or as agreed by the customer and Pestkart Enterprises sales representative at the time of order booking.
4. Customer Preparation: Before treatment, customers are requested to move movable furniture at least 2 ft. away from walls, completely empty infested wooden wardrobes, and clear only the bottom area of unaffected wardrobes, cabinets, wall units, and other fixed wooden furniture. Pestkart Enterprises technicians are instructed not to handle customer property.
4a. Re-treatment: In the event of termite recurrence, Pestkart Enterprises will provide re-treatment services.
4b. Timely Response: All reported termite infestations will be attended within 24 hours if reported before 3 PM on working days.
4c. Visits: All visits during the contract period are of charge.
4d. Customer Vigilance: Customers are advised to regularly check wardrobes and other wooden items that are inaccessible to the termite control operator.
4e. Timely Reporting: Even minor infestations should be reported promptly to Pestkart Enterprises customer care to avoid wood damage.
4f. Damage Exclusion: Damage to wooden articles or other valuable items is not covered under the maintenance contract.
5. Post-Treatment Termite Sightings: Customers may observe live termites immediately or days after treatment depending on infestation severity. This is normal, as termites searching for food may enter treated zones, become infected, and carry the infection back to their colony, resulting in control over time.
6. Customer Disclosure: Customers must inform Pestkart Enterprises technicians of any concealed electrical wiring, telephone cables, or plumbing pipes to avoid damage during drilling. The company is not responsible for damages if this information is not provided.
7. Additional Arrangements: Customers should arrange for an electrician and/or carpenter at their own cost if treatment requires handling electrical fixtures or fixed woodwork.
8. Facility Provision: Customers must provide electricity for drilling, water for mixing chemicals, and necessary ladders or stools to treat infestations at elevated locations.
9. Access to Ceilings and Lofts: Customers should provide access to false ceilings and lofts for inspection and treatment.
10. Treatment Conditions: The drilling equipment produces noise and pesticides may have a slight odor. Customers are requested to bear with this. Patients, pets, children, or senior citizens should not be present during treatment and may only return after the premises are well-ventilated and cleaned with a dry cloth.
11. Non-Transferability of Service: Services are non-transferable. If customers change premises, a new agreement must be signed based on infestation level and condition at the new location.
12. Complete Treatment Requirement: For best results, the entire area of the apartment, flat, building, or cabin must be treated. Termite recurrence is possible if any area is left untreated.
13. Scheduling: Treatments are scheduled as per mutually agreed time frames. The company is not responsible if premises are unavailable for treatment at the scheduled date and time.
14. Health Advisory: Since anti-termite treatments involve chemicals and may have odors, it is recommended that patients and pets be moved out during treatment. Pestkart Enterprises is not responsible for any side effects, illness, or death.
15. Terms Update: The company reserves the right to update these terms from time to time without prior notice.
16. Jurisdiction: All disputes arising out of this contract shall be subject to the jurisdiction of courts in Delhi only.
General Pest Control Terms and Conditions:
Access and Cooperation: Customers must ensure full cooperation of all residents, employees, or members of the premises (residence/society/corporate) where the treatment is to be carried out. In certain cases, it may be necessary to move furniture to facilitate the service. All rooms, cabins, flats, or relevant areas must be made available for service at the time of the visit. Failure to provide access will be considered as service rendered, and no refund shall be provided in such cases.
Service Timings: Service visits will be scheduled within a reasonable time from the receipt of an enquiry and will be conducted during regular working hours of Pestkart Enterprises. No service visits will be carried out on Sundays or other gazetted holidays unless specifically requested. Services on holidays will attract an additional charge of at least ₹300, subject to the job profile.
Re-treatment Clause: If the targeted pest reappears during the contract period, and provided that all instructions and conditions have been duly followed, the company will provide necessary re-treatment at no additional cost.
Safety Precautions: Children, pets, senior citizens, asthmatic or allergic individuals must not be present during the treatment and until the premises have been thoroughly cleaned afterward.
Liability Disclaimer: The company shall not be liable for any damage, injury, death, or consequential loss to any person or property arising out of the service provided.
Change of Address: The contract is valid only for the premises mentioned in the agreement. If there is a change of address, a new contract must be entered into with applicable charges.
Contract Termination: This contract is non-transferable and non-terminable by the customer before its expiry. However, Pestkart Enterprises reserves the right to terminate the contract at any time, in which case a pro-rata refund will be issued after deducting applicable administrative charges.
Payment Terms: Contract charges must be paid in advance via cash, cheque, or demand draft in favor of "Pestkart Enterprises." A signed copy of the contract and the payment must be submitted before the commencement of services.
Customer Complaints: In case of any complaints, customers must provide their name, address, and contact number to Pestkart Enterprises' Customer Care Executive. A copy of the contract and payment receipt must be retained and presented to facilitate verification and service.
Supersession Clause: This contract supersedes all previous agreements, arrangements, or understandings, whether oral or written, related to the services provided.
Property Damage Disclaimer: The company is not responsible for any damage to the interior or exterior of buildings, rooms, walls, cabins, or flats that may occur during the performance of the treatment.
Service Failure Disclaimer: Pestkart Enterprises is not responsible for failure of treatment if instructions are not followed or if treated areas are disturbed, washed, painted, or modified after the service.
Presence of Representative: The customer must ensure that a representative or responsible person is present during the treatment for safety and security reasons. This individual shall be considered an authorized signatory to confirm completion of service.
Post-Service Acknowledgment: Customers are required to sign the service declaration slip after the treatment is completed and before the technician leaves the premises.
Promotional Communications: Customers may receive transactional or promotional SMS or calls from Pestkart Enterprises.
Non-Refundable Clause After First Service: Once the contract has commenced and the first service has been successfully delivered, no refund or partial refund shall be entertained under any circumstances.
Terms Updates: Pestkart Enterprises reserves the right to update these terms and conditions without prior notice.
Jurisdiction: All disputes arising out of or in connection with this contract shall be subject to the jurisdiction of courts in Delhi only.
